Everyone has a responsibility to act with reasonable care to avoid causing catastrophic harm and injury to others. Those who fail must be held accountable. California Personal Injury Laws

During a personal injury claim in Los Angeles, it is critical to understand at least a few core laws. The doctrines surrounding a personal injury case could make or break the success of your catastrophic injury claim. If you don’t comply with the statute of limitations on filing, for example, California courts could bar you from repossession. The rules that apply to your claim will depend on the type of case. It is important to know at least the basic laws involved in your claim.

Car Accidents

California is a fault-based car accident state. After a car accident, all parties injured in the crash will seek financial damages from the at-fault party’s insurance provider. You or your attorney will need to identify the cause of your car accident and the defendant before filing suit. Pure comparative negligence rules may apply. This California law states that even when a plaintiff contributed to your accident, the courts will still award some compensation. However, the courts will reduce the award based on the plaintiff’s percentage of fault. This law could reduce your recovery if you were partially at fault for your car accident.

If you were injured in a car accident and want to file a lawsuit against the at-fault party, you have up to two years to do so. Two years is the California statute of limitations on all personal injury claims. If you only file a property damage claim, you have three years from the date of the accident to file. However, this time frame is reduced to just six months if you are naming a government entity as the defendant in your personal injury lawsuit. Act quickly to ensure you meet the application deadline. Courts do not normally hear cases filed after the statute of limitations.

Dangerous Products

Dangerous products may contain defects or problems that pose a risk of harm to consumers. The manufacturer may have made a mistake that makes the product excessively dangerous during normal use. The legal doctrine of strict product liability applies to most dangerous product claims. This doctrine states that a manufacturer, distributor, or retailer may be strictly liable for a victim’s damages if that victim can prove that one of the three types of defects existed and that this is what caused the injuries in question.

Inherent design flaw

-Manufacturing error or error

-Negligent or improper marketing

Strict liability means you don’t have to prove the defendant was negligent to get compensation for your damages. Dangerous product claims also come with a unique statute of repose: a maximum of 10 years to file your claim. If you didn’t discover your injuries until years later (i.e., in a case involving a defective medical implant), you have a maximum of 10 years from the date the cause of action accrued to file your claim.

Wrongful Death

A wrongful death claim gives family members the right to seek financial damages from one or more parties responsible for causing the death of a loved one. Wrongful death lawsuits in California come with unique laws that do not apply to other types of injury cases. Instead of having a time limit of two years from the date of the accident, you have two years from the date of your family member’s death to file a civil lawsuit in California. The only parties entitled to file a wrongful death claim are the surviving spouse, domestic partner, children, parents, or someone entitled to the decedent’s estate through intestacy.

California Damage Limits

The state of California has passed laws that limit the damages or financial compensation that a plaintiff can recover during a case in some situations. Damage caps serve to protect critical defendants in the community, such as hospitals and doctors, from bankruptcy. They can also reduce an award based on a plaintiff’s actions or inactions, such as, in California, a driver’s failure to purchase auto insurance.

Proposition 213 has a single limit for car accident victims in California. It states that if a driver involved in an accident did not have at least the minimum required amounts of insurance, that driver cannot recover non-economic damages. This rule is valid even if the uninsured driver was not at fault for the crash. Non-economic damages refer to those such as pain and suffering, emotional distress, and loss of consortium. Economic damages, such as vehicle damage and medical bills, are still available.

California also sets a cap on medical malpractice damages. The Medical Injury Compensation Reform Act states that if a medical professional or other health care worker caused your injuries in California, you can only recover up to $250,000 in total non-economic damages from the defendant. This is the state limit for general or intangible losses during all medical malpractice claims.

California Comparative Negligence

A doctrine of comparative negligence states that more than one party could share fault for the same accident. Instead of assigning 100% of the fault to either the defendant or the plaintiff, the two could split the blame and the plaintiff could still receive a reduced compensatory award. In a contributory negligence state, a plaintiff will receive $0 in recovery if he or she was responsible for 1% of the accident. However, in comparative negligence states like California, a plaintiff could be 99% at fault and still receive a portion of a compensatory award.

California’s doctrine of pure comparative negligence means that there is no limit on the plaintiff’s share of fault. Instead, some states use modified comparative negligence laws, which limit the victim’s ability to recover from 49% to 51% of the fault. If you think it might have contributed to your accident or injuries, talk to our Los Angeles injury attorneys anyway. Comparative failure will not prevent you from recovery. However, you can lower your settlement or verdict by an amount equal to your percentage of fault. If you receive a court awardof $100,000 but were 10% at fault, for example, the courts would reduce your award by 10% ($10,000). Having an attorney handle your case could help you minimize your comparative fault to maximize your financial outcome.

What is the statute of limitations on Los Angeles personal injury claims?

As a California accident victim, you do not have an infinite amount of time to file a personal injury claim. If you have a lawsuit in Los Angeles or anywhere else in California, you must file the correct paperwork before the state’s deadline. The legal term for this period is the statute of limitations. California has a two-year statute of limitations on most personal injury claims. You must file your lawsuit within two years of your accident or the courts will prevent you from recovering financially. However, there are some exceptions to the rule.

If the plaintiff is an injured minor, such as your child, your family will have two years from the date the child turns 18 to file a personal injury claim, even if it is more than two years from the date of the child’s 18th birthday. the date of the accident. Another exception exists in most claims involving criminal tort. A civil lawsuit following a homicide, for example, may allow two years from the date of the resolution of the criminal case against the same defendant for the plaintiff to file.

How is negligence proven?

During a California personal injury lawsuit, the burden of proving someone’s fault falls on the injured party’s side of the case (the plaintiff). That is why it is important to hire an experienced Los Angeles injury attorney to handle your claim for you. Your attorney will have experience proving negligence and convincing a judge or jury to agree with your side based on the evidence. Your attorney will need to prove four main elements to obtain a settlement or jury verdict on your behalf:

Duty of due diligence. The person allegedly at fault for your injuries (the defendant) must have owed you a duty to exercise reasonable care at the time of your accident.

Breached duty of care. The defendant must have intentionally or recklessly breached a duty of care to you in a way that another prudent party probably would not have done. Causality established. Your attorney will need to prove causality between the defendant’s breach of duty of care and your accident. Injuries suffered. Your accident attorney will also need proof that you suffered damages due to the defendant’s actions, such as hospital bills or lost wages.

How much is your personal injury case worth?

-Pain and suffering

-Exemplary or punitive damages

-Medical expenses

-Property damage repair

-Wages lost

Our Los Angeles personal injury attorneys have achieved impressive results for previous clients through hard work, personalized legal strategies, and aggressive case negotiations. We have the power to negotiate settlements with insurance companies, as well as file personal injury claims in court anywhere in California, if necessary. The potential value of your personal injury case will depend on the severity of your losses. Learn the value of your case during a free consultation with an accident attorney at our personal injury law firm.

How much does a personal injury attorney charge?

Your attorney will cost you nothing unless we are successful in obtaining financial compensation for you. Our law firm operates on a contingency fee basis for all personal injury claims in Los Angeles. We only charge our clients for our services if we win their claims, and only then after the award is won. You will pay your attorney directly from your settlement or judgment award rather than out of pocket. The amount charged will be a pre-agreed percentage based on a contract with your attorney. The use of contingency fee agreements helps us keep high-quality legal representation affordable for our clients.

How can a Los Angeles car accident attorney help?

If you’ve been seriously injured or a loved one has been killed in a car accident, the last thing you need to worry about is fighting with the insurance company for fair compensation. It can be tempting to accept the first offer the insurance company comes up with just to bedone with it. Unfortunately, that offer is often far less than the amountof compensation you’ll need to cover medical expenses, ongoing medical care, lost wages, and other costs. No matter what type of car accident your case involves, you can trust us to fight for your best interests. We will take care of your legal needs, so you can focus on your recovery and taking care of your family.

We can take motor vehicle cases involving:

-Truck accidents

-Motorcycle accidents

Common Car Accident Injuries

Our Los Angeles car accident attorneys focus heavily on car accident law due to the frequency and severity of these accidents. In Los Angeles County in 2021, the most recent year data is available, there were 40,669 fatal and injury crashes. Car accidents often cause serious, catastrophic, and life-altering injuries to victims living in Los Angeles. We understand how these injuries affect people and how to best help them fight for proper compensation. We can help clients with all types of personal injury during car accident claims.

-Traumatic brain injuries

-Permanent disabilities

-Soft tissue injuries

-Burns

-Fatal injuries

-Wrongful death

We also help clients fight for compensation for non-physical injuries. California law allows plaintiffs to seek compensation for their emotional, mental, and psychological suffering, as well as their physical pain and economic losses. Our firm can help you seek a fair amount for your pain and suffering, emotional damages, distress, pain, anguish, and post-traumatic stress disorder after a serious car accident.

California Car Accident Laws

California has complex car accident laws that are important to understand as a victim. Otherwise, you could accidentally make a mistake that results in less compensation for your damages, or no compensation at all. After a serious accident in Los Angeles, contact an experienced Los Angeles car accident attorney as soon as possible for information about your specific accident. We can make it easy to navigate the laws related to your case.

Statute of limitations

One of the key laws to be aware of is your statute of limitations or deadline for filing a claim. In California, all crash victims have two years from the date of their car accident to file injury claims and three years for property damage claims only. Courts generally do not grant exceptions to this rule. The clock may not start ticking until the date of discovery if it is later than the date of the collision.

Car insurance due to fault

California follows fault-based auto insurance laws. All drivers must have adequate vehicle insurance: bodily injury coverage ($15,000 per person, $30,000 per accident) and property damage liability ($5,000). After an accident, injured parties will file claims with the at-fault party’s insurance provider for damage recovery. Injured victims may also have the right to file lawsuits in lieu of insurance claims, depending on the situation.

Liability laws

The state of California does not prevent a victim from obtaining a financial recovery for partially causing a car accident. Instead, pure comparative negligence rules will reduce the victim’s compensation by their percentage of fault. Even if the victim was 99% responsible for causing the accident, they may still be able to recover 1% compensation. An attorney from our firm can help you defend against a comparative negligence defense.

Compensation for car accident victims in California

If you are able to file a claim for damages, we will help you understand what types and amounts to include in your initial demand letter against the party at fault. Every car accident case is unique, with different damages and losses suffered by survivors. Looking for the right amount can increase your chances of securing a successful insurance settlement.

-Existing medical debt

-Future hospital bills and health care expenses

-Accommodations for temporary or permanent disability

-Past and future lost wages

-Vehicle repairs or replacement

-Physical pain and suffering

-Emotional stress

-Mental anguish

-Loss of enjoyment of life

-Wrongful death damages

-Punitive damages

If you suffered catastrophic injuries or a loved one was killed in a car accident in Los Angeles, your case could be worth a significant amount. work accidents

What do I do after being in an accident at work?

The period after an accident can be disorienting, to say the least. The most important actions are getting help, documenting the situation and as many details as you can remember. That means objectively evaluating your situation, contacting your employer’s insurance company, and doing everything in our power to ensure you’re protected. After an accident at work, it is important that you immediately document the situation and all the details you can remember about it. It is important to acquire video evidence and witnesses to help support your case. Obviously, you need to make sure you are safe and secure immediately after an accident at work. Once you’ve done that, it’s up to you to collect as much evidence as possible. It’s easy to overthink this, but just taking a few photos of where the accident happened can do wonders. If you can’t or can’t, consider asking a friend, colleague, or family member to take pictures and video. That said, you can still collect evidence even after you’ve left the scene of the accident. Taking photos and videos of your injuries can only help. We can help your worker’s compensation case even without this, but anything can be helpful. Going forward, our workers’ compensation attorney can guide you through the compensation process. No charge unless we win. We understand that it is critical for us to win your case before charges are filed. Our job is not done until the case is won and provided to you. We have a reputation for aggressive trading and believe in giving our best. Throughout the process of your case, our workers’ compensation attorney will always be available to you as our client. Time and time again our clients have been satisfied with our services.

Why do you need a workers’ compensation lawyer?

Anyone in a work environment is susceptible to accidents or injuries. In the unfortunate event that you are seriously injured at the workplace, you need to know that you are eligible for a workers’ compensation attorney. As competent attorneys, we want to make sure you receive the proper medical care and compensation you deserve after an accident at work. The other party will have the best attorneys possible, backed by years of experience and vast resources. You deserve the same. By having a professional workers’ compensation attorney on your side, you have the best chance of success.

How long does a workers compensation case take?

Every case is different and depending on how minor or extreme the case is, there is a different time frame from when the case is filed until a settlement is reached. Our attorneys make sure they stay on top of every case, making sure you never miss key deadlines and maintaining the lines of communication throughout the process. It is important that your attorney has experience in injury cases. Since our attorney only handles injury cases, he knows the procedure of an injury case. In addition, our work accident attorney is extremely knowledgeable about all types of injuries. Each injury affects your lifestyle in different ways. It is important to understand the treatment required for each type of injury. Our attorney understands how an injury affects your life. Additionally, our attorney knows what it takes to fairly compensate his clients. The truth is that all too often, insurance companies and others will try to drag out the process as long as possible. Their hope is that you give in, allowing them to get away with giving you less money than they deserve.

Why hire us as your workers’ compensation attorney?

We don’t charge unless we win. So you never have to worry about paying us. We support you every step of the way, negotiating aggressively on your behalf. We will always be available to you, and help you during this time so that you end up with the compensation you deserve. The sooner you hire a workers’ compensation attorney, the sooner the money you may receive can be in your pocket. From the moment we sit down with you for an initial consultation, we will get to work taking care of you. When you contact us, we’ll explain the process, the case timeline, what to expect, and more. You will be clearly and effectively informed of what type of case you have. Also, we say this without any “legal jargon”. We give you the simple truth from the beginning. We are a team of understanding lawyers. After we’ve stepped in to cover your case, we include it in frequent updates and communicate with you along the way. We are proud to represent you as a welcoming team. Based on our experience and commitment, our firm is an excellent choice for clients. We are competent and ready to fight for you to receive all the benefits you deserve. When you’re injured on the job, you’re up against some of the largest insurance companies in the world. They have one goal: tomake sure you receive less compensation than you deserve. We can work to make sure that doesn’t happen.

Don’t wait to take action!

If you are injured on the job in California, you are entitled to compensation. It really is that simple. It may not seem like it. You might think that you have to be seriously injured to receive compensation. Or, if you’ve already applied for workers’ compensation and your claim was denied, you have no chance of receiving money. That’s not true. The law gives no recourse to those who wait. Workers’ compensation cases must be filed within one year of your work injury. However, if it has been more than a year since your accident, you can still file your case. No matter what we will help you in any way possible. Any type of on-the-job injury is a potentially traumatic situation. The last thing you want is not to receive the compensation you deserve for everything you’ve been through (or no compensation at all). Contact our team to discuss your options and rights. What workers’ compensation benefits are you entitled to? With our proven track record of negotiating excellent settlements for our clients, we can put you in a position to confidently address your medical needs and more. Every case is different. There is no set time frame for reaching an agreement. That is why our attorneys stay on top of each case. Through careful maintenance of three lines of communication, we are there for you at every step of the process.

If you are injured in an accident at work, you may be entitled to the following:

-Permanent Disability Settlement

-Future Medical Care Agreement

-Free Temporary Disability Benefits

-Rehabilitation Bonus

-Reimbursement for Mileage Expenses

If you are permanently disabled, you are entitled to receive money for future lost earnings in a Permanent Disability Settlement. Your disability may affect your ability to perform different jobs and you may not be able to perform regular job duties. If you need medical treatment for the rest of your life, our attorneys will fight for a settlement that ensures you can pay for future medical expenses. This is known as a Future Care Agreement. You are entitled to temporary disability benefits if you are unable to work because of your injury. After a doctor has ordered you not to work, you are eligible for these benefits. These benefits also apply if your current employer is unable to provide you with appropriate accommodations based on your work restrictions. Due to these limitations, you may be given an equivalent of your average weekly earnings.
